The purpose of this document is to define the conditions under which the company Nuuuuuut, hereinafter referred to as the Platform, offers an intermediation service aimed at connecting independent bicycle repairers, hereinafter referred to as Partners or Repairers, with end-users, hereinafter referred to as Clients, wishing to benefit from repair, maintenance, or assistance services for their bicycles. Concurrently, the Platform may also offer Clients direct sales of products and services, hereinafter referred to as Direct Products or Services. The use of the Platform and access to its services imply the full and unreserved acceptance of these General Conditions as well as our Privacy Policy. Any registration, order, or use constitutes unreserved acceptance of all these provisions. Furthermore, any Partner registering on the platform acknowledges and accepts the Partnership Conditions.
Nuuuuuut acts in a dual capacity: firstly, as a technical intermediation and connection platform, where it does not provide bicycle repair services itself. Service contracts are concluded directly between the Client and the Repairer. The Platform acts solely as an intermediary and shall not be held liable in this regard. However, it provides a technical interface facilitating the search for Repairers, appointment scheduling, and payment management. Secondly, Nuuuuuut acts as a direct seller of Products and Services, where the Platform may offer for sale Products (e.g., spare parts, accessories) or Direct Services (e.g., specific maintenance packages offered directly by Nuuuuuut and not by an independent Partner). In this case, Nuuuuuut acts as the seller and is directly responsible for the conformity and performance of these Direct Products or Services.
Each Repairer is an independent professional. The Client is solely and fully responsible for the services they offer and perform via the Platform, including the quality of the service, adherence to deadlines, conformity of the parts used, safety of the intervention, and any legal or commercial warranty related to their services. Repairers must be duly registered, qualified, and hold all professional insurance required by applicable law for the exercise of their activity, which they commit to maintain throughout their collaboration with the Platform. Nuuuuuut cannot be held responsible for the actions, omissions, or errors of the Repairers. The Repairer agrees to provide Nuuuuuut with all necessary information for billing and for social and tax declarations of transactions.
The Client agrees to provide accurate and complete information regarding the problem with their bicycle or their order of Direct Products or Services, as well as their contact details. They must respect the time and place of the appointment agreed upon with the Repairer for intermediation services. The Client acknowledges that the Platform is not responsible for the quality of services provided by independent Repairers and that any claim regarding the performance of these services must be addressed directly to the concerned Repairer. For Direct Products and Services sold by Nuuuuuut, the Client agrees to respect the conditions of use or installation.
The booking of an intervention for intermediation services is carried out via the Platform, by selecting a Repairer, a time slot, and describing the desired service. Payment for the service is managed by the Platform via a secure third-party payment provider. The amount of the service is communicated to the Client before confirmation and includes the Platform's commission. The payment is collected once the service is validated by the Client. For Direct Products and Services, the order is placed online via the Platform. The Client validates their cart, provides the necessary information for delivery or execution of the service, then proceeds to payment. The prices of Direct Products and Services are indicated in euros, all taxes included (VAT included) or excluding taxes, excluding delivery costs, which are specified before the order is validated. Payment is made via the secure payment methods offered on the Platform. The order is considered confirmed only after full payment has been received.
Products sold and stored directly by Nuuuuuut are generally shipped within 1 to 5 business days after payment validation. Shipping times are specified on each product page. Delivery times are entirely dependent on the service providers selected by Nuuuuuut for shipping the Products. Delivery costs are calculated based on the types of products, the speed requirement, the weight, the volume of the products, and the destination, and are clearly indicated to the Client before the validation and payment of the order. Delivery is free for all orders of at least €480.
Regarding cancellations, withdrawals, and returns: in the event of cancellation of intermediation services by the Client, they may cancel a booking free of charge up to a specified time before the appointment; after this deadline and up to the time of the appointment, cancellation will result in the billing of all or part of the service. In the event of cancellation of intermediation services by the Repairer, the Client will be fully refunded any sums already paid for this service, and the Platform will endeavor, as far as possible, to offer a replacement Repairer. Regarding the right of withdrawal applicable to Products and Services sold directly by Nuuuuuut, in accordance with the legal provisions in force (articles L. 221-18 and following of the French Consumer Code), the Client has a period of fourteen (14) calendar days from the receipt of the Product or the conclusion of the service contract to exercise their right of withdrawal without having to provide reasons or pay penalties. For services whose execution has begun before the end of the withdrawal period, with the express agreement of the consumer and their express waiver of their right of withdrawal, the right of withdrawal cannot be exercised. To exercise their right of withdrawal, the Client must notify Nuuuuuut of their decision by an unambiguous statement before the 14-day period expires. This notification must be made by email to super@nuuuuuut.com or via the contact form available on our website: https://nuuuuuut.com/contact. The request must include the relevant order number and the reference of the Product(s) the Client wishes to return. Following the withdrawal notification, Nuuuuuut will inform the Client of the procedure and the return address for the Product. The Client then has fourteen (14) calendar days from this notification to return the Product at their own expense. The costs of returning the Products are borne by the Client, except in the case of a defective or non-compliant product. The refund for the Direct Product or Service will be made within fourteen (14) days following the receipt of the withdrawal request or, for Products, after the effective receipt of the returned Product in perfect condition. Products must be returned in their original and complete condition, allowing them to be resold as new. Opened, damaged, soiled, or incomplete products will not be accepted. In the event of a dispute concerning the intermediation Service, as services are not tangible goods, they cannot be "returned," and the Client must inform the concerned Repairer directly. The Platform may, at its sole discretion and without obligation, offer mediation between the Client and the Repairer to attempt to resolve the dispute, with the Repairer remaining solely responsible for the legal warranty obligations related to their services and the parts used.
Regarding the legal warranties of Products and Services sold directly by Nuuuuuut, in accordance with legal provisions, Nuuuuuut is responsible for defects in conformity of the Products and Services sold directly under the contract under the conditions of article L. 217-4 and following of the French Consumer Code and for hidden defects of the item sold under the conditions provided for in articles 1641 and following of the French Civil Code. The legal guarantee of conformity applies independently of any commercial warranty that may have been granted. The consumer has a period of two years from the delivery of the goods to invoke the legal guarantee of conformity. They can choose between the repair or replacement of the goods, subject to the cost conditions provided for in article L. 217-9 of the French Consumer Code. They are exempt from providing proof of the existence of a lack of conformity of the goods during the twenty-four months following the delivery of the goods, except for second-hand goods. For hidden defects, the consumer can choose between the cancellation of the sale or a reduction of the sale price in accordance with article 1644 of the French Civil Code.
The Platform's liability is limited as follows: acting as a simple technical intermediary for the Repairers' services, it cannot be held liable for any direct or indirect damage resulting from the contractual relationship between the Client and the Repairer. For Direct Products and Services, Nuuuuuut's liability, if engaged, would be limited to direct and specific damages suffered by the User and directly related to the technical operation of the Platform or the non-compliance of its own direct sales, to the exclusion of any indirect or intangible damage. The Platform does not guarantee the constant availability of Repairers nor the systematic resolution of all requests.
The Platform collects and processes personal data in accordance with applicable regulations, the terms of which are detailed in Nuuuuuut's Privacy Policy, available on the website. All elements of the Platform (texts, images, graphics, logos, icons, sounds, software) are the exclusive property of Nuuuuuut. Any reproduction, representation, modification, publication, or adaptation of all or part of the site's elements, regardless of the means or process used, is prohibited without the prior written permission of Nuuuuuut.
These General Conditions are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. In accordance with the provisions of the French Consumer Code relating to the amicable settlement of disputes, Nuuuuuut offers the Client the right to consult a consumer mediator, whose contact details will be provided upon request or on the Platform's website. In the absence of an amicable agreement, the French courts shall have sole jurisdiction.
Nuuuuut reserves the right to modify these General Conditions at any time. The new conditions will be communicated to Users by any means and must be accepted for any continued use of the Platform's services.
